CISE - Cluster Exploratory (CluE)

Awarded projects must execute a usage agreement before any access to the
cluster will be provided. The following key contractual points, among other terms and
conditions in the form of a Computing Resource Agreement, are provided to you for your
awareness.
- Use of the cluster of virtual machines for data intensive, parallel computing
workloads ("Virtual Infrastructure") is limited to faculty and staff of the respective
Universities who have agreed to the terms and conditions of the form of End User Agreement
("University Personnel"); and (ii) undergraduates and graduate students of the respective
Universities who have agreed to the terms and conditions of the form of End User Agreement
("University Students"). Use of the Virtual infrastructure is solely for authorized
educational and research purposes and users must acknowledge and agree to abide by
appropriate use restrictions, and acknowledge that operation and access to the Virtual
Infrastructure are not guaranteed and use is at the users' risk.
- University Personnel are solely responsible, including on behalf of the University
Students, for obtaining any requisite third party licenses, if necessary, for any data to
be loaded and used on the Virtual Infrastructure.
- University will not allow any third parties, other than University Personnel and
University Students, to access or in any manner use the Virtual Infrastructure, without
(i) the prior written consent of IBM and/or Google; or (ii) entering into the applicable
forms of Computing Resource Use Agreement and End User Agreement with IBM and
Google.
- Under certain circumstances, IBM and/or Google may terminate the applicable Computing
Resource Agreement and such Universities' access to the Virtual Infrastructure with ten
(10) days prior written notice to the University in question. Access and use of the
Virtual Infrastructure may be denied by the Universities as well in their discretion or
for violation of University policies or the terms of the End user
Agreement.
- Universities and their respective University Personnel and University Students shall
only use the Virtual Infrastructure in full compliance with the U.S. embargo regulations
of the U.S. Treasury Department, the U.S. Export Administration Regulations of the U.S.
Commerce Department and the International Traffic in Arms Regulations of the U.S. State
Department (collectively, "Applicable Export Control Laws"). Universities are responsible
for their own compliance with any Applicable Export Control Laws and must establish an
export control plan to ensure such compliance.
